The Decree Of His Excellency Amir al-Mu’minin “The Supreme Leader” (May Allah Almighty Protect Him) Concerning the Procedure for Processing Legislative Documents
Article One:
- The initial draft of a legislative document shall be prepared by the relevant administration.
- The administration is obliged to establish and assign a committee composed of scholars, experts, and experienced professionals in the relevant field to prepare the initial draft.
- If the implementation of the legislative document pertains to multiple administration, a joint committee shall be established and assigned, based on mutual agreement among the relevant administrations, including scholars and experienced professionals from each administration to draft the initial version.
- The administration with the greater responsibility in the implementation of the legislative document shall lead and coordinate the activities of the committee mentioned in Clause (3) of this Article.
- The committee assigned in Clauses (2) and (3) of this Article are obligated to search for and extract juristic references from Hanafi jurisprudence books for articles that have Shariah aspect.
Article Two:
- Ministries and Emirati administrations are obliged to send the initial drafts of relevant legislative documents to the Ministry of Justice for Shariah research, scrutinization, and thorough evaluation.
- The Ministry of Justice is responsible for thoroughly scrutinizing and finalizing the initial draft mentioned in Clause (1) of this Article through scholars and professional members of the legislative and legal- academic research directorate.
- The esteemed scholars of the legislative and legal-academic research directorate of the Ministry of Justice are obligated to investigate and scrutinize Shariah-based articles, especially those extracted by the relevant departments from Hanafi jurisprudence sources.
- The Ministry of Justice is responsible for preventing contradictions between legislative documents.
Article Three:
- To conduct the final review of legislative documents an independent commission shall be established.
- The Ministry of Justice is responsible for submitting the final draft of legislative documents to the commission mentioned in Clause (1) of this Article for second review and processing.
- The commission mentioned in Clause (1) of this article is obligated to thoroughly review the final draft received from the Ministry of Justice, make all necessary corrections, and submit it to the leadership.
- The Final Review Commission of legislative document is the ultimate authority for examining and correcting legislative documents. After this the draft is considered ready for endorsement and is submitted for the endorsement of the His Excellency Amir al-Mu’minin (May Allah Almighty Protect Him).
- For the Final Review Commission of legislative documents, a dedicated secretariat and administrative structure shall be established.
Article Four:
Legislative documents, after endorsement, shall be sent to the Ministry of Justice for publication in the official gazette.
Article Five:
This decree shall come into effect from the date of its endorsement and shall be published in the official gazette.
